Terms and Conditions
1. Scope
1.1 These general terms and conditions apply to all orders placed by customers via the online shop of NaturaVelit eG, Blumenweg 1c, 8303 Bassersdorf, hereinafter referred to as NaturaVelit eG.
1.2 By confirming the order, these general terms and conditions are deemed accepted by the purchaser.
2. Offer and Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order.
2.2 By clicking the button (Order), the customer places a binding order for all products listed on the order page.
2.3 Immediately after receiving the order, NaturaVelit eG confirms the order by email. The purchase contract is concluded immediately for non-physical goods and upon delivery for physical goods.
3. Prices and Shipping Costs
3.1 The prices stated on the product page include statutory value-added tax, but exclude other price components (shipping, packaging) and are in Swiss francs (CHF). The exact shipping costs will be displayed to the customer during the ordering process.
3.2 No additional taxes or costs (except for customs duties for deliveries abroad) will be charged.
3.3 The provider reserves the right to change prices at any time. The prices published on the website on the date of the order apply to customers.
3.4 For every sale, 5% of the total net sales amount and shipping costs are invested in nature. This amount is passed on to aid organizations or projects. 4. Delivery Terms
4.1 Delivery of physical goods is only available within Switzerland and the EU.
4.2 The delivery time is, unless stated otherwise in the offer, 1 to 2 working days for Switzerland and Liechtenstein. For deliveries to the EU, the delivery time is between 5 and 10 working days. If a longer delivery time is necessary, the customer will be informed no later than after this period has expired. If no information is provided, the customer is entitled to waive the delivery.
4.3 If not all ordered products are in stock, NaturaVelit eG is entitled to make partial deliveries.
4.4 If the delivery of the goods fails three times due to the customer's fault, NaturaVelit eG may withdraw from the contract. Any payments made will be refunded immediately.
5. Payment Terms, Payment Default
5.1 Payment is made by invoice, credit card, Postfinance or Paypal for customers in Switzerland. For customers in the EU, payment is made exclusively via Paypal, credit card or advance payment.
5.2 Our invoices must be paid without deduction within 30 days of the invoice date (due date), unless a different payment target has been agreed. After the expiry of the notified due date (= expiration date) on the invoice, the purchaser is in default in accordance with Art. 102 para. 2 of the Swiss Code of Obligations (OR).
5.3 When paying by Paypal, the customer's account will be charged at the time of ordering.
5.4 Offsetting with disputed or legally unconfirmed counterclaims of the customer is excluded.
5.5 The customer may only exercise a right of retention insofar as the claims are based on the same contractual relationship.
5.6 If the purchaser does not pay due invoices, exceeds a granted payment target or if the purchaser's financial situation deteriorates after conclusion of the contract or we receive unfavorable information about the purchaser's creditworthiness after conclusion of the contract, which raises doubts about the purchaser's solvency or creditworthiness, we are entitled to demand the immediate payment of all our claims arising from the same legal relationship, while amending the agreement made, to request advance payment or security, or immediate payment of all our claims after delivery. This applies in particular if the purchaser stops paying, a check from the purchaser is not honored, insolvency proceedings have been applied for or opened over the assets of the purchaser or if the insolvency proceedings have not been opened due to insufficient assets.
6. Retention of Title
The goods remain the property of NaturaVelit eG until full payment has been received. Prior to transfer of ownership, pledging, transfer by way of security, processing, or modification without the consent of NaturaVelit eG is not permitted.
7. Right of Withdrawal
7.1 Consumers have the right to revoke the contract declaration within 14 days of receiving the goods. The revocation must be communicated in writing by email, fax or letter to NaturaVelit eG. The time of dispatch of the revocation is decisive for compliance with the deadline. A reason for the revocation is not required. 7.2 Exercising the right of withdrawal leads to the conversion of the purchase contract into a transaction for the reversal of the transaction, after which the services received within the scope of the purchase contract must be refunded. The consumer must return the received goods with the original packaging to NaturaVelit eG within 14 days after the declaration of the withdrawal. The costs for the return shipment are borne by the consumer.
7.3 Upon receipt of the goods, the purchase price will be refunded to the consumer immediately if it has already been paid. A deduction of the purchase price to be refunded remains reserved for possible damages or excessive wear and tear of the goods. No deduction is made if the loss in value is due to handling necessary to determine the nature, characteristics, and functioning of the goods. NaturaVelit eG may refuse repayment until the goods have been returned or until the consumer has provided proof that the goods have been returned, depending on which is the earlier point in time.
7.4 The right of withdrawal is excluded for the following points:
- Individual company solutions that are clearly tailored to the personal needs of the customer.
- Digital content whose execution takes place at the same time as the order and which is not delivered on physical data carriers.
- Services that have already been fully provided or whose execution has already begun.
8. Warranty and Liability
8.1 NaturaVelit eG warrants that the goods correspond to the promised characteristics, have no defects that impair their value or suitability for the intended use, and comply with the prescribed performance and specifications. NaturaVelit eG reserves the right to remedy an existing defect or to deliver a defect-free item in the form of rectification or replacement.
8.2 The buyer is obliged to check the delivered goods as soon as possible and to report any defects immediately. You can find our customer service department at: https://www.naturavelit.ch/en/contact.
8.3 If rectification or replacement is unsuccessful, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. The customer's right to a reduction in price is excluded.
9. Contract Duration, Entitlements, and Termination for Subscriptions
Subscriptions are entered into for a certain duration. In most cases, this duration is 6 or 12 months. Each subscription entitles one person, unless otherwise agreed, to unrestricted use during the term of the contract. Prior to the expiration of the subscription, the customer will receive an invoice for the renewal of the contract for the same period. Termination must be communicated in writing to NaturaVelit eG within 30 days of this date. At the same time as the termination, the access authorization will expire.
10. Passwords / Confidentiality
In the case of products provided online, the customer is obliged to treat the provided access data to the system as well as any set passwords with the utmost confidentiality and care. NaturaVelit eG reserves the right to immediately terminate the right of use upon discovery of the multiple use of access data by a single authorized person.
11. Copyright
Das bedeutet, dass der Kunde die publizierten Produkte und das Internetangebot der NaturaVelit eG nutzen darf, jedoch nur zum Eigengebrauch. Eine kommerzielle Verbreitung von Inhalten ist ohne ausdrückliche Zustimmung der NaturaVelit eG nicht erlaubt. Die NaturaVelit eG behält sich das Urheberrecht an allen Beiträgen und Arbeitshilfen vor.
12. Liability
NaturaVelit eG excludes liability for slight negligence in the event of a breach of contract. The same applies to breaches of contract by agents and substitutes. NaturaVelit eG assumes no responsibility for errors that are not within its sphere of responsibility, in particular with regard to telecommunications service providers, the hosting provider or other third-party service providers.
13. Jurisdiction and Applicable Law
The contractual relationship between the customer and NaturaVelit eG is subject to Swiss substantive law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980. For disputes arising from these contractual relationships, the ordinary court in Zurich shall have jurisdiction.
14. Final Provisions
If any part of these general terms and conditions should be ineffective, the validity of the remaining provisions shall not be affected. In place of the ineffective provisions, the relevant statutory provisions shall apply by analogy.
